Summary/Abstract: The requirement to obtain permission to use building is the last part of the investment process. Therefore, the issues related to the arbitrariness in use are of major importance in practice. This is especially true of financial penalties for illegal use of the building, where it is essential to indicate the person liable to pay a fine. This obligation applies to the investor, but only in exceptional cases, the obligation is imposed on the entity that allowed the illegal use. In addition, the nature of the case indicates that the adjacent property owners are not party to the proceedings for the imposition of a fine.
