Summary/Abstract: The Law no 102/2014 on cemeteries, human crematoriums and funeral services provides that the concessionaire’s heir enjoys a pre-emption right over the burial plot. Therefore this article aims to clarify the nature of this so-called “pre-emption right”, which can really be only a right of preference to continue the concession started by the deceased, not a legal right to buy the burial plot and thus acquire the ownership over it.
