Summary/Abstract: This is a paper on civil disobedience and its justification. A lot of ink has flowed on this complex and stormful question, as it’s mainly a matter of the individual facing the political authority, and yet the debate is far to be over nor a generally accepted „solution“ to be found. Justifying civil disobedience is a quite difficult task as it concerns a disagreement with a legitimate authority whose decisions or politics are normally backed up by most of the social agents, constituted in the political majority. The hard questions in play are therefore: Is it ever justified to disobey the majority will? or Are justice and truth always related to the majority?. The moral question deeply involved is about how an individual have to react when obeying a certain law means a contradiction with his given convictions or when his individual rights are violated on one hand, and how is the majority to react when faced to a justified, from a moral point of view, act of law disobedience, on the other hand. This paper is a briefly attempt to take a hint on possible answers to these problematic questions and to reject the idea that civil disobedience is always a danger for a democratic society, for it challenges the democratic procedures. This last idea is an easy way of rejecting a problem, that is a challenge for a political theory, by refusing any rational argument, and therefore constitutes a piece of a red herring for any political theory.
