Legal opinion on competences of Deputies’ Ethics Committee (possibility of examining cases involving violation of Rules of Deputies’ Ethics by former Deputies)

Summary/Abstract: The subject of the opinion is an assessment whether the Deputies’Ethics Committee should examine cases concerning violating the Rules of Deputies’Ethics by former Deputies. According to the author – and the rule of discontinuation– proceedings started in the former term of the Sejm and not concluded with adecision of the Committee might not be examined by the Committee in the followingterm. Competences of the Committee involve only Deputies of the term in whichit was formed, and they concern only actions (delicts) committed in the course ofthis term.
