Summary/Abstract: Rules of court fees are not always sufficient to combat the matter of corporate blackmail, which can cause great damages for the companies. This article concerns interpretation of specific regulation of the Commercial Companies Code, namely the1st sentence of Art. 423 § 2. The civil sanction established in this Article may be interpreted as the increased costs of court proceedings but also as the civil penalty.The purpose of this article is to dispel the doubts arising at its background. Theauthor presents the method of calculating the amount of the penalty payment and the prerequisites of its application.
