Summary/Abstract: In this article, the author deals with the form of real estate pre-contracts, in light of the Civil Code of Romania. The structure and contents of the article reveal commentaries on the validity of a real estate sale promise, on articles from the Civil Code, such as art. 1.279 („promissory contract”), art. 1.225 („The object of the contract”) and art. 1.669 („The promise of sale and the promise to purchase”), and also on the form of the promise, taking into account the doctrine elaborated by important names in the field of law (N. Conachi, Gh. Gheorghiu, Fl. A. Baias, R. Constantinovici, I. Macovei, F. Popa). In closing, the author draws conclusions regarding the valorification of the promise to sell a land plot, manifested in the form of a deed by private signature.
