Thoughts on the Legal Content of Levirate Marriage

Summary/Abstract: The rules of succession of power under a seniority system ensure stability within tribes or tribal organisations; the legal institution of levirate marriage provides a special guarantee for the survival of the clan. Presumably, the principle of forfeiture of rights can be also recognised in the bases of the institution of levirate marriage under ancient pagan customary law, just as the right and interests to “keep the dowry” within the husband’s clan is not the only element that can be identified in its development.The study reveals and demonstrates that basically and in terms of the history of development it is primarily the protection of the rights of the widow that prevailed in the institution of levirate marriage.
