Selection Limits Defined in the Law vs Infringement of Personal Rights of Civil Servants

Summary/Abstract: This article is to prove that under the existing law creation of the public image of the civil servants may influence their attitude to employment relationship. The legislator did not point to any objective criteria which should be used to evaluate if a given person meets selection limits regarding unspotted character and flawless reputation. Thus personal rights are in relations with defined selection limits. In the article basic categories of personal rights whose infringement may influence evaluation of a public figure are presented. It is also shown what the protection of personal rights means and what kinds of claims a public figure whose personal rights have been infringed can have. Additionally, the influence of the infringement of personal rights may have on the person’s employment is discussed.
