Summary/Abstract: In 2014, a new Tobacco Products Directive (Directive 2014/40/EU) was adopted, laying down new rules for member states regarding the manufacture, presentation and sale of tobacco products and other related products on the market. Among others, the new Directive requires that health warnings appear on packages of tobacco and related products, covering 65% of the front and back of cigarette packages, bans the sale of certain tobacco products with special flavouring and the use of small dimension packaging for certain tobacco products and bans all promotional and misleading elements on tobacco products. Allowing member states to introduce even more restrictive measures in their national legislation for the sale and promotion of tobacco products, such as plain packaging, the Directive raised many questions within the industry. Following the introduction of tobacco plain packaging in Australia and the premises of plain packaging law to be adopted in New Zealand, Ireland is the first EU member state to confirm its intention of prohibiting the use of trademarks and other figurative elements and devices on the tobacco market and limit such use to standardized packaging throughout the tobacco industry
