Summary/Abstract: The general clause unjustified dismissal is an undefined concept having its widest applicationin labor relations. This clause provides an alternative to the closed list of reasons for termination ofemployment by allowing courts to deliver judgements reflect circumstances in specific facts. The flexibility of general clauses allows you to change the way their understanding of the changing external conditions, political, and even on the occasion of changes in the value system. At the same timethe requirement of a reasonable notice, to recognize the legality of this action, is controlled not onlyfrom the point of view of Art. 45 of the Labour Code, but also the principles of social coexistence.
