Summary/Abstract: The Roman iuris prudentes used with predilection the evaluative sentences, reminding contemporarygeneral clauses, making the Roman law itself flexible and timeless. In the private lawthe sentences like bona fides (good faith), bonum et equum (good and right), ratio aequitatis (rightreasons), utilitas (utility), natura rerum (nature of things) presented such character. In the penal lawthe role of the general clauses has been limited, but the expressions like utillitas publica (publicinterest) or dolus malus (wrong intention) have been presented as well.
