Summary/Abstract: The commented judgment of the European Court of Justice constitutes an attempt to resolve a dispute between Groupement des Cartes Bancaires (a grouping of several French banks) and the European Commission. The Court rejects the stance of the General Court according to which the measures applied by the appellant banks had the aim of restricting competition on the market for payment cards in France. The interpretation of the notion of „restriction by object” in the light of Art. 101 (1) TFEU endorsed by the ECJ significantly alters its current view on this matter and may be foreshadowing a new, more comprehensive and careful approach to the reading of the anticompetitive “object” of an agreement.
