Summary/Abstract: The subject matter of this thesis is the situation of the accused in judicial proceedings in the light of the adversarial principle and the right to defense, which will be discussed with particular reference to the rights granted to the defendant in the light of the currently binding Code of Criminal Procedure with amendments of 2013. The thesis attempts to demonstrate the defendant’s ability to affect the judicial proceedings by exercising the rights granted at this stage of the criminal procedure. Amendments to the Code of Criminal Procedure of 2013 also grant to the defendant the right to file multiple motions to obligate the prosecutor to release specific preparatory proceedings materials.
