The assent of the general prosecutor of the Prosecutor’s Office attached to the High Court of Cassation and Justice as regards the appointment, promotion and release from office of policemen holding positions in the judicial police

Summary/Abstract: The author analyzes the nature of typical or atypical administrative document taking into consideration art. 2 par. (1) c) and i) of the Law no. 554/2004 on contentious administrative matters, the order issued by the general prosecutor of the Prosecutor’s Office attached to the High Court of Cassation and Justice, pursuant to art. 55 par. (4) of the Code of criminal procedure, art. 2 par. (3) and art. 6 par. (1) and (2) of the Law no. 364/2004 on the organization and functioning of the judicial police, as amended and supplemented, by which the appointment to the structures of the judicial police is not approved or the notice of appointment is withdrawn. The author also deals with the possibility to file for appeal against this order before an administrative court apart from the order issued by the Minister of Internal Affairs on the appointment/release from office of a judicial police officer.
