The rights of the injured party in the frame of a plea bargain agreement (Arts. 478-488 of the Penal Procedure Code).

Summary/Abstract: The special procedure of plea bargaining agreement under the new Criminal procedure code, adopted by Law no. 135 of July 1, 2010 and published in the Official Gazette, Part I, no. 486 of July 15, 2010, was conceived by the legislature as a modern, innovative legislative solution, with implications on the solution of the case within an optimal and predictable period of time. It represents a remedy for the elimination of the long duration of the proceedings in the court. It is considered an abbreviated form of trial for certain offenses aimed at increasing the responsibility of the parties and at increasing of the effectiveness of the courts.
