Summary/Abstract: The article was conceived starting from the existence at prosecution services and courts in the country of many cases that refer to persons who smuggle cigarettes into the country, hold and / or sell cigarettes that do not bear the marks issued by the Romanian state. In this text, the author investigates possible legal classification that can be given to offenses committed by persons holding unmarked or improperly marked cigarettes or bearing false marks, regardless of quantity.
