Summary/Abstract: According to par. 18a of the Insurance Activity Act, the insurance companies might proportionally differentiate the premiums due to the gender of the insured. On the 14th of December 2012, Polish Parliament introduced changes to the Insurance Activity Act from the 22nd of May 2003. The amendment concerns the introduction of the interdiction to use gender as a factor affecting the risk assessment of the insured person. The change was made due to the need to implement into the national law the judgment of the European Court of Justice as of the 1st of March 2011. Case C-236/09 Test-Achats.The calculation of premiums based on life expectancy tables separately for men and women and comparison of the results with the calculated unisex premiums confirmed that the consideration of gender factor is essential for calculation of premiums and shall be adequate to the risk. As the risk of death is strongly correlated with gender, making premiums for women and men significantly differs from one another.The new premiums of life and endowment insurance will be higher for women and lower for men, with the largest differences observed in case of insurance term with long insurance period. The opposite would be the case in the market of annuity insurance, where the situation of men will be worse. The differences in premiums for each type of insurance product will be more noticeable for older people as well as for the insurance, where the premium payment period will be shorter than the insurance period.
