Applying the principle of “non bis in idem" in the work performed by the law enforcement bodies

Summary/Abstract: I appreciate that the principle of „non bis in idem” established in art. 4 of the Protocol no.7 to the ECHR, should be stated and applied in the prosecution stage and judicial investigation stage, when a person is prosecuted or investigated for the second time for the same act, when there is already a final court decision of conviction or acquittal or the prosecutor has confirmed the solution of removal or ending of criminal prosecution.
