Summary/Abstract: The article presents an analysis of the medical and legal aspects of the concepts of insanity, incapacity and limited capacity. The common and the distinctive features of these concepts are shown. Using the historical and legal method and the techniques of comparative analysis, the author reveals the changes that have happened in the legal regulation of the sphere concerning the determination of the degree of sanity and capacity. The problems arising when implementing compulsory medical measures are studied. The need for a differentiated approach to the definition of incapacity is pointed out.
