Considerations concerning the taking of the decision of medical hospitalization as a safety measure

Summary/Abstract: Security measure of medical hospitalization is provided in the text of the art.114 of the Penal Code. The peculiarity of this measure consists of the nature of the case that creates the situation of risk, of the kind and intensity of the risk against which the measure is taken and of the spatial way in which the situation of risk is combated. The measure of medical hospitalization refers to a situation of risk generated by the abnormal psycho-physical condition of the perpetrator which alters severely his life and existence, as such a perpetrator is not able to realize normally and to be master of his actions or inactions.
