The historical development of the relationship between criminal law and the fundamental Law in Romania (I)

Summary/Abstract: This article presents the historical relationship between criminal law and the Constitution in Romania. It is structured in two parts: the first part examines the linkages between the first Criminal Code of Romania and subsequent constitutions (1866 and 1923). The second part continues the analysis on the relationship between Carol Penal Code and other Constitutions of Romania (1938, 1948, 1952, 1965). The first art surprises the correspondence between the core values ​​that are also protected by the criminal law: the principle of legality, the principle of non retro-activity, the right to life, liberty, integrity physic, inviolability of the home. Also we consider the evolution guarantees the fundamental values ​​of a constitution to another.
