RENTĂ BUGETARĂ PENTRU PASIVITATEA CULPABILĂ A PROPRIETARULUI IMOBILIAR

Summary/Abstract: In this article, the author examines the increasingly frequent emergence, in the judicial practice, of a certain type of actions located at the borders, on both sides of the border, of the abuse of right and fraud committed by the initiators, but also of the gross negligence of the entitled persons/obliged to settle them, namely, the judges. The structure and the content of the study reveal the comments on the categories of inactive owners, as well as on the fact that within a more recent practice, the actions for the recovery of possession were dismisses according to irrevocable decisions, based on certain arguments exposed therein. Finally, the author formulates brief considerations regarding the conations for which, briefly, the actions presented therein were correctly dismissed, in the author’s view, in the current judicial practice, as well as some particular references in relation to the consequences of granting such actions and which are of interest.
