Summary/Abstract: The European Commission proposed in January 2013 far reaching measures to encourage more innovation in European railways by opening domestic passenger markets to competition. Rolling stock availability is one of the most important access barriers to the railway passenger transport market. Faced with this problem, the European Commission proposed to introduce an obligation for competent authorities to take the financial risk of the residual value of rolling stock by a choice of appropriate means e.g. by assuming ownership of the rolling stock, providing a bank guarantee for the purchase of new, setting up of a ROSCO (leasing company). The main aim of this article is to analyse the problem of rolling stock availability in the context of the mechanism proposed by the European Commission in order to facilitate access to rolling stock.
