Summary/Abstract: Bargaining agreement is the convention by which the parties undertake to negotiate in good faith to conclude a future contract, whose elements are not yet established or are only partially. The main obligation to which it gives rise is to negotiate in good faith. A constant of this convention lies in the existence of a potestativ right of unilateral withdrawal of the contract in favour of each of the parties. Under negotiation may arise, on behalf of the parties, the obligations of confidentiality, of sincerity, of exclusivity, of paying of different studies.
