A COMMON EUROPEAN ASYLUM SYSTEM AND EU'S ACQUIS CONCERNING THE MIGRATION CRISIS IN EUROPE

Summary/Abstract: The paper discusses the instruments of EU acquis that are useful to addressthe challenges stemming from the irregular mixed flows of migrants to Europehappening since the beginning of 2015. The paper covers the legal situation as of17 February 2016. The first part encompasses a description of the refugee statuswith a background analysis of the premises of refugee legal definition, and outlinesother instruments of granting international protection. The second part summarizesthe asylum procedures, including the controversial rules of determining which stateis responsible for reviewing the asylum application (Dublin III), the SAR operationsin the Mediterranean Sea with the issue of disembarkation, and the proceduresconcerning temporary reintroduction of internal border controls within the Schengenarea. Finally, the last part includes a review of the measures undertaken by theEU since April 2015, including the European Migration Agenda and the bindinglegislation on the cessation of international protection, acquis regarding returns andrights of long-term residents.
