LEGAL NATURE OF CONTRACT OF REPAIR

Summary/Abstract: The aim of this article is to highlight the difficulties in determining the legal nature of ‘contract of repair’. Proper assessment of such an agreement is possible by interpreting both subject of the agreement and its provisions, especially taking article 647 of the Civil Code into account, which requires the proper application of article 658 of the Civil Code. In addition, the content of that agreement must be interpreted in accordance with the provisions of the Act – The Law of Building. The correct classification of the ‘contract of repair’ either as a contract of works or as a contract of work is essential to deal with disputes between the parties to that agreement.
