Summary/Abstract: Penalty by military arrest in currently existing penal code, taking into account some rules of the executive penal code, is presented in the paper. The study also includes an overview of military arrest penalty in the Penal Code of 1969, which, without doubt, is a predecessor of the penalty in actual form.
