Summary/Abstract: Legal subjectivity of communities is an important matter, since the time of the Second Republic of Poland. In the current legal system legal subjectivity of communities is still the subject of discussion. Although the Constitution does not indicate the formulation of legal subjectivity of communities, however it is clear from the analysis of constitutional rules defining the scope and method of operation. Legal subjectivity of communities is rooted in the Constitution. This act defines communities as a public entity, showing the rules which guarantee its subjectivity.
