Summary/Abstract: The Act on National and Ethnic Minorities and the Regional Language guarantees rights for national and ethnic minorities, including the German national minority. The Act sets the politics of the Polish state towards minorities and clarifies their rights. It contributes to the maintenance of the German cultural heritage and serves as a protection and guarantor of the German minority rights in Poland. The Act regulates mainly the law concerning the language use in the spelling of first and last names in the private and public life (a minority language as an auxiliary language in some offices), the naming of streets and towns (double naming), and the issue of education for children and young people from minorities. Those listed issues in the context of the application of the letter of the law and towards the German minority in Poland are the subject of the article. At the same time, the author attempts to give an answer for two questions: how the German minority in Poland uses the rights contained in the Act in the above mentioned issues and how they affect the environmental life of the German minority in Upper Silesia and in other parts of the country.
