The principles of land acquisition for public roads in Poland

Summary/Abstract: The study discusses the ways of acquisition of land for the purposes of constructing public roads. In the recent years we have witnessed development of the public road network in Poland; as well as the modernisation of existing routes. Unfortunately; the development of the road network was slowed down by legal regulations that hindered the possibility to acquire land for the construction of public communication roads. This state of affairs has; in a way; forced the adjustment of legal regulations to facilitate the acquisition of land for public roads by public administration and self-government bodies. Current legal regulations permit several ways to acquire real property for the purposes of road investment; including sales agreements; expropriation; and decision on permission for the performance of a road investment. The new form significantly simplifies the procedure of land acquisition for the realisation of public road investments; which in turn accelerates the process of constructing public roads.
