Summary/Abstract: The subject of this opinion is to assess the constitutionality of the proposed amendments to the Family and Guardianship Code. According to the author, the proposed changes to the premises for dissolution of marriage by divorce and the introduction of the possibility of dissolution of marriage solely on the basis of consistent declarations of intent of both spouses filed before the registrar, disturb the pattern of distribution of the rights and obligations of the parties to a marriage and the principle of legal formalism and principle of judicial procedure for examination of the grounds for dissolution of marriage by divorce, derived from Article 18 and Article 47 of the Constitution. In addition, the author claims that Article 4 of the bill infringes the constitutional principle of sound legislation derived by the Constitutional Tribunal from Article 2 of the Constitution by omitting the transitional provisions.
