Disciplinary liability of the bailiffs in republic of Moldova - realities and perspective

Summary/Abstract: The functionality of the enforcement of civil judgments in the Republic of Moldova is characterized by frequent changes in the regulatory framework, including those related to the disciplinary liability of the bailiffs. The purpose of this communication is to analyze how and to what extent the disciplinary liability of the bailiffs contribute to realization of creditors’ rights. In this context, the intention is to analyze the problematic aspects of the disciplinary liability of the bailiffs in the Republic of Moldova. Of particular interest is the circumscription of the concept of misconduct which can result in a sanction applied by the Disciplinary Collegium; breach that eventually leads to cancellation of the enforcement act by the court following a request of annulment. As we face Government’s serious intention to reform the justice sector, we hope that within the improvements in civil procedure will be found the proposals on lege ferenda related to the disciplinary liability of the bailiffs.
