Summary/Abstract: Although according to the preamble of the Law regarding the new civil procedure code the legislator proposed itsself the creation of simple, suple, clear, concise, precise enforcement procedures that would finally lead to the enforcement of titles in the shortest time possible and with costs as reduced as possible, having a great opportunity of realizing this through the elaboration of a new civil procedure Code, the legislator did exactly the opposite, regulating an enforcement procedure extremely formal, contradictory, difficult, outside the realities of executional practice and this leads to greater costs, lenghtier procedures and sometimes to blocking or even rendering impossible the completion of the executional procedure.
