Legal Opinion concerning the legal personality of independent public health care facilities under the Act on Medical Activity.

Summary/Abstract: The opinion deals with the question whether, on the basis of new regulations on medical activity, independent public health care institutions have legal personality. The author claims that, in the light of the new Act on Medical Activity independent public health care institutions could not be created. Existing hitherto independent public health care institutions, in spite of the loss of the binding force of the Act on Health Care Facilities, do not lose their legal status because it this has not been clearly expressed by the Act. The loss of legal personality – as well as granting it – must derive directly from the provisions of the Act, and cannot be alleged nor interpreted.
