Summary/Abstract: The military criminal procedure rules in Austria (dating back to 1768) were quite old-fashioned by 1900. There were many attempts to reform criminal procedure after 1850. However it was not clear whether the emperor himself or the parliaments were competent to enact new rules. This article examines the arguments for both views.
