New way of medical damage compensation – substantive and procedural law remarks

Summary/Abstract: The New Polish extra-judicial system of compensation coming into force on January 1st 2012 gave the patients a new legal instrument to obtain compensation of damage which happened during treatment. The authors discuss the premises of the medical treatment evaluation, the possible amounts of compensation and some rules of procedures before the medical events commission. The authors criticize the new laws, indicate the very low sums of compensation and the lack of individual approach to a patient as a victim of medical event. The rules for procedure of evaluation of existence of medical event are criticized for their incoherence and lack of precision.
