Summary/Abstract: This paper deals with positive prescription as the original way of property acquisition. This is a practical institution of general public interest, thanks to which the factual situation prevails over legal concerns. First of all, the author exposes the issue through a general concept and necessary terms and conditions that must be met,so that it is incorporated, i.e. the elaborated terms in the paper are conscious,legal and righteous possession, required time lapse, as well as rules occurring with deadlines. Finally, the author addresses the issue of legal effectofpositive prescription and its justification
