Summary/Abstract: The beginning of democracy after 1989, and consequently the beginning of independent Slovak Republic brought new atmosphere into the life of the entire society. It was reflected in the relationship between Church and the state. While communistic regime during four decades fought against all religions, new democratic society is looking for new ways of cooperation between the Church and the state. It reflected in many areas. The first concrete result of this cooperation is recognition of those marriages that were entered into in Church and also according to system of law in Slovak Republic. This legislation is in law 36/2005 Z.z. It is the result of mutual negotiations between the Government of the Slovak Republic and the Holy See and its result is interstate agreement on development of cooperation between state and the Catholic Church in the Slovak Republic. It was accepted on 24 November 2000. This agreement in that time included valid legislation, under which, the civil legislation recognized as valid those marriages that were contracted according to canon law. It began new circumstances and legal structures that are theme of this paper.
