Some remarks on separation with equalization of accrued gains

Summary/Abstract: Separation of assets with equalization of accrued gains was introduced to the Family and Guardianship Code in 2005. However the regime is not popular. The reason for the lack of popularity is the fact that the provisions regarding the regime are not comprehensive and are a source of many doubts. In this article the current regulation has been discussed. Furthermore foreign solutions concerning this model of regime have been presented. The final part of the article shows the directions of amendments which could make the regime more attractive.
