Changes in the legislation governing the profession of the real estate agent

Summary/Abstract: The analysis of the current regulation of the profession of real estate agent, leads to the conclusion that the deregulatory changes are correct and satisfy the principle of proportionality. However, abolishing the duty of the education and the absence of a definition of the agency are raising doubts. It is caused by the fact that the scope of the third party liability insurance is not determined by the legislator. The duty of insurance of the third party liability can be an adequate guarantee of the inspection of this area of the professional activity. However, the current construction of the this obligation is raising doubts as for the compatibility with the principles of good legislation (Art. 2 of Constitutions).
