Protection of the interests of workers in the public procurement system − selected issues

Summary/Abstract: In the regulation of the EU secondary law in the field of public procurement it is possible to observe the progressing instrumentalization in the plain determined as socially responsible ordering. This instrumentalization consists in leading legal instruments serving indirectly or directly the protection of the interests of employees and job seekers. These instruments are then introduced into the Polish legal system through the implementation of EU directives in the Public Procurement Law Act. They take the form of orders addressed to the contracting authorities, or permission to stand contractors social requirements binding on the stage of the performance of the contract. Their presence in the procurement legal regime creates the problems related to possible conflicts of intention to carry out the values associated with the protection of the social interests with foundation of the public procurement system, which is the realization of the internal market freedoms and the competition rules.
