The successor rights of the surviving spouse - correlation between the rights of the surviving spouse and the chosen matrimonial regime

Summary/Abstract: The current paper aims to analyze the configuration of the right to inheritance of the surviving spouse, subsequent to the coming into force of the new Civil Code, especially from the perspective of the matrimonial regime chosen by the spouses, other than the legal one - the conventional community regime or the separation of goods regime. The successor rights of the surviving spouse presents certain particularities as opposed to the previous regulation stated in Law no 319/1944.
