Summary/Abstract: The waranties have a very big role to play in the insolvency procedure. The need to guarantee the liabilities ocurred as a protection measure, as a life jacket offered to the lenders in order to shelter themselves from the risk of the debtor. This need was born out of the insecurity the lenders felt, derived from the general risk of nonpayment and from the contest between the others unsecured creditors.
