Summary/Abstract: The appeal is regulated also in the new code of civil procedure, to the most extent on the same coordinates as those deemed already traditional in our procedural law. This article represents a first part of a study dedicated to the new regulation of the appeal3). This first part examines the manner in which the defining features of the appeal are expressed by the new code, as well as the content of certain new solutions and concepts that this regulation introduces in this matter. The devolutive effect of the appeal, the concept of procedural indivisibility and the concept for explaining the claims, the possibility of cancelling the contested decision and of evoking the merits shall be commented in a detailed manner, among others.
