Summary/Abstract: Compliance with the European Union’s fundamental rights is ensured by the European courts of justice, primarily the ECJ. Additionally, the European Union Agency for Fundamental Rights was brought into existence. Its aims were to help the European Union’s institutions and the member states with implementing the fundamental rights by providing expertise. Its jurisdiction was the community law, i.e. the EC-Treaty. With the Treaty of Lisbon, the pillar structure was abandoned and the third pillar was integrated into the Treaty of the Function of the European Union (TFEU) now replacing and complementing the EC-Treaty. The question is if the scope of the FRA was extended by the changes in the structure of the European treaties. Therefore it is imperative to decide whether the founding-regulation is to be interpreted statically or dynamically.
