Summary/Abstract: Examination of a witness is undoubtedly the most frequently used burden of evidence in terms of civil trials. Considering its crucial importance it is necessary to analyze some issues occuring in practice when this burden of evidence used in a consistent manner, taking into consideration aspects of rights and lawful interests of the witness itself.
