Notes on the Project for General Part of a New Penal Code

Summary/Abstract: With Decision no. 50/31.01.2014 the Council of Ministers of Republic of Bulgaria approves the project for Penal Code (PC) and proposes to the National Assembly its adoption. This article contains a critical analysis of institutes from the General Part of the PC in the project. Proposals have been made for the improvement of the regulatory frame of the limits of the necessary defense, the capturing at the crime scene, the volitional moment of the oblique intent, intent of accessories, forms of accessoryship, voluntary refusal - expression of the activist's will, the continual crime („delictum continiatum"), the dangerous recidivism and rehabilitation.
