Summary/Abstract: The article is focused on existing legal regulation of interim measure pursuant to § 76a of the Civil Procedure Code. This interim measure is used in the case the minor child found himself/herself without any care or if his/her life or favourable development is put at a serious risk or is affected, or if the child is placed into the foster care for an interim period. The aim of the article is to analyze the current legal situation and chart a major problematic issues arising from it. All of this with regard to the forthcoming act on special judicial proceedings, which shall include the regulation of this interim measure.
