Summary/Abstract: The text analyses valid legislative in the Republic of Croatia which regulates the museum sector. Besides a short survey of existing laws and regulations we are referring to some problems that exist in various fields within the cultural sector and have influence on museums. It has been pointed out that some rules are uncoordinated or not well balanced and therefore open possibilities for misunderstanding and even court trials. The text also mentions legislative obligations that cannot be fulfilled, neither by museum founders nor museums themselves which brings then to the point of breaking the law. Museums have to implement the whole series of activities in various segments of their work for which they do not have secured finances nor human resources. Therefore, we can raise a question why such legislative has been passed at all since it was obvious right from the start that there is no financial support for covering those expenses. The text also mentions advantages and faults that accompany a detailed legislative in the museum sector. Since the Ministry of Culture of the Republic of Croatia put a lot of efforts in defining various aspects of work and involvement of museums they have managed to set a well-defined framework for development of museums. On the other hand the system is not flexible because it is difficult to introduce changes that are become an imperative in a present-day dynamic surroundings as it involves a complicated procedures of changing the law.
