Commentary of art. 16 of the Labor Code

Summary/Abstract: The essence of the amendment brought to art. 16 consists of the elimination of the former para. (2) of art. 16 which established the presumption of concluding an individual labor contract over an undetermined period of time, if the said contract was not concluded in a written form. The solution proposed by the legislator starting with 2011 is criticizable taking into consideration many of the arguments that will be presented in this paper.
